1. Acceptance of Terms
By accessing or using the MyCarmeta's National Food Security Portal ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use the Platform. These Terms constitute a legally binding agreement between you ("User", "you", or "your") and the Barbados Agricultural Development and Marketing Corporation (BADMC) ("we", "us", or "our").
2. Platform Operator
The Platform is operated by the Barbados Agricultural Development and Marketing Corporation (BADMC), a statutory corporation established under the BADMC Act, Cap. 325 of the Laws of Barbados, in collaboration with the Ministry of Agriculture, Food and Nutritional Security. 3. Platform Description
The Platform is a national agricultural ERP and food-security system that provides: • Farmer Portal: Harvest tracking, livestock management, onion drying bookings, procurement alerts, payout tracking, and input credit applications • Customer Portal: Marketplace shopping, preorders, weekly basket subscriptions, order tracking, and delivery management • BADMC/Ministry Portal: Procurement management, inventory control, POS retail, logistics and delivery management, finance and payout administration, forecasting, weather alerts, and food-security reporting The Platform facilitates interactions between farmers, customers, BADMC staff, and Ministry personnel to strengthen Barbados' agricultural supply chain and food security.
4. Eligibility
You must be at least 18 years of age and legally capable of entering into contracts under the laws of Barbados to register an account. By registering, you represent and warrant that: a) You are at least 18 years old b) You are a resident of Barbados or are accessing the Platform from a jurisdiction where such access is lawful c) You are not prohibited from using the Platform under any applicable law d) All information you provide is accurate, current, and complete BADMC reserves the right to verify eligibility and to refuse or terminate accounts at its discretion.
5. Account Registration and Authentication
You may register using email/password or via Google OAuth sign-in. You are responsible for: a) Maintaining the confidentiality of your credentials b) All activities that occur under your account c) Providing accurate information and updating it promptly when it changes d) Notifying us immediately of any unauthorised use of your account BADMC reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or pose a security risk. Each person may maintain only one account per role.
6. User Roles and Portal-Specific Rules
The Platform supports distinct user roles, each with specific rights and responsibilities: a) Customer Portal Users: Use the Platform for personal or business purchasing of agricultural produce. Resale of platform-facilitated goods without prior written BADMC approval is prohibited. Customers must provide accurate delivery addresses and payment information. b) Farmer Portal Users: Only registered Barbadian farmers with a valid BADMC farmer registration number may access the Farmer Portal. Farmers must: • Provide accurate harvest data, livestock records, and farm details • Honour procurement commitments they make through the Platform • Deliver committed quantities in the grade and condition specified • Maintain current bank account details for payout processing • Use drying facilities only for booked and approved sessions Misrepresentation of farm data or failure to honour commitments may result in account suspension, withholding of payouts, and referral to relevant authorities. c) BADMC / Ministry Portal Users: Restricted to authorised BADMC and Ministry of Agriculture personnel. Credentials are non-transferable. Staff must: • Process procurement, inventory, and finance transactions accurately • Maintain confidentiality of all data accessed through the Portal • Not use their position for personal gain or unauthorised activities • Comply with all BADMC internal policies and Barbadian law d) Finance Users: Authorised finance staff may create, approve, and process farmer payouts, manage input credit, and administer POS revenue. All financial actions are logged and auditable.
7. Procurement and Commitments
BADMC may issue procurement requests through the Platform specifying target quantities, grades, parishes, and price per pound. a) Farmer Commitments: When a farmer commits to a procurement request, that commitment constitutes a binding intention to supply the stated quantity of produce at the specified grade and delivery date. b) Confirmation and Delivery: BADMC must confirm each commitment. Once confirmed, the farmer is expected to deliver the committed quantity. Upon delivery, BADMC logs the stock to inventory and a payout is automatically created for Finance processing. c) Failure to Deliver: If a farmer fails to deliver a committed quantity without reasonable cause, BADMC may: • Cancel the commitment • Adjust the farmer's procurement priority for future requests • Withhold pending payouts until the matter is resolved • Suspend the farmer's account in cases of repeated non-delivery d) Quality and Grade: BADMC reserves the right to reject deliveries that do not meet the specified grade or quality standards. Rejected produce will be returned or disposed of at the farmer's expense.
8. Orders, Payments, and Payouts
a) Customer Orders: All orders placed through the Customer Portal are subject to product availability. BADMC reserves the right to cancel orders due to stock unavailability, in which case any payment made will be refunded. b) Payment Methods: Accepted payment methods include bank transfer, card, mobile payment, and vouchers, as available at the time of transaction. c) Farmer Payouts: Payouts are calculated based on delivered quantity and the price per pound specified in the procurement request. Payouts are subject to: • Deduction of outstanding input credit balances (where applicable) • Verification of delivery and quality • Finance approval workflows d) Payout Processing: Payouts are processed through bank transfer, cheque, cash, or account credit as selected. BADMC aims to process approved payouts within 10 business days, subject to banking timelines. e) Input Credit: Input credit (seed, fertilizer, feed, etc.) is disbursed at BADMC's discretion based on application review. Repayment is typically via harvest deduction. Outstanding balances may be deducted from future payouts. f) Disputes: Any dispute regarding a payout or charge must be raised within 30 days of the transaction date by contacting contactus@badmc.org. g) Fraud: BADMC reserves the right to withhold or adjust payouts in cases of suspected fraud, dispute, or regulatory compliance requirements.
9. Weekly Basket Subscriptions
Customers may subscribe to a weekly produce basket (Standard, Family, or Premium). Subscriptions are subject to the following: a) Billing: Weekly subscription fees are billed in advance. b) Pausing and Cancellation: Subscribers may pause or cancel their subscription at any time. Pauses or cancellations must be made before the weekly cutoff to affect the next delivery. c) Delivery: Basket contents vary weekly based on seasonal availability. BADMC does not guarantee specific items in any given basket. d) Payment Status: Subscriptions with overdue payment status may be automatically paused until payment is received. e) Refunds: Refunds for prepaid baskets are issued at BADMC's discretion for service failures or cancellations initiated by BADMC.
10. Onion Drying Facility
a) Bookings: Farmers must submit a drying booking request through the Platform. Bookings are subject to availability and BADMC approval. b) Intake and Output: The intake weight is recorded at drop-off. The dried output weight may differ from the intake weight due to moisture loss. BADMC is not liable for weight reduction that occurs during the natural drying process. c) Spoilage: BADMC takes reasonable care during the drying process but is not liable for spoilage caused by pre-existing crop conditions, disease, or factors beyond its control. Spoilage losses are recorded and communicated to the farmer. d) Storage and Sale: Dried produce may be stored at BADMC facilities and listed for sale on behalf of the farmer, subject to applicable storage fees and terms communicated at the time of booking. e) Cancellation: Farmers who repeatedly cancel approved drying bookings without notice may have future booking priority reduced.
11. Point of Sale (POS) and Retail
BADMC operates retail outlets using the Platform's POS system. All POS transactions are final except where: a) A product is confirmed spoiled or substandard — a refund or exchange may be issued b) A billing error is identified and reported within 7 days of the sale Receipts are issued at the point of sale. Customers are encouraged to retain receipts for any refund or exchange request.
12. Prohibited Conduct
You agree not to: • Submit false, misleading, or fraudulent information • Attempt to gain unauthorised access to any part of the Platform, its data, or infrastructure • Use automated tools (bots, scrapers, crawlers) to extract data without written permission • Interfere with Platform operations, other users' access, or system security • Impersonate another person or entity • Create multiple accounts to circumvent restrictions • Use the Platform for any unlawful, fraudulent, or abusive purpose • Distribute spam, malware, or harmful code through the Platform • Reverse-engineer, decompile, or disassemble any part of the Platform software Violation of these provisions may result in immediate account suspension, legal action, and referral to law enforcement.
13. Intellectual Property
All Platform content, branding, logos, software, database structures, forecasts, and reports are the property of BADMC or its licensors and are protected by Barbadian and international intellectual property laws. You may not: • Reproduce, distribute, or publicly display Platform content without prior written consent • Create derivative works based on the Platform • Use BADMC branding, logos, or names without authorisation • Extract, scrape, or download bulk data from the Platform Platform data accessed through your account is licensed to you solely for your use in connection with Platform services and is not transferable.
14. Weather and Forecast Information
Weather alerts, forecasts, and supply-demand predictions are provided for informational and planning purposes only. BADMC sources weather data from the Barbados Meteorological Services and other recognised providers. a) No Guarantee: BADMC does not guarantee the accuracy or timeliness of weather forecasts or supply predictions. b) No Liability: Farmers and other users make operational decisions at their own risk. BADMC is not liable for losses resulting from actions taken or not taken based on forecast information. c) Advisory Nature: All weather alerts and forecast recommendations are advisory. Users should exercise their own judgement and consult additional sources for critical decisions.
15. Disclaimers and Limitation of Liability
a) "As Is" Provision: The Platform is provided "as is" and "as available." BADMC makes no warranty regarding uninterrupted availability, error-free operation, or specific results from using the Platform. b) No Advice: Content on the Platform (forecasts, alerts, recommendations) does not constitute professional agricultural, financial, or legal advice. c) Limitation of Liability: To the maximum extent permitted by Barbadian law, BADMC shall not be liable for: • Indirect, incidental, special, or consequential damages • Loss of profits, crops, livestock, or business opportunities • Downtime, data loss, or service interruptions • Actions taken by third parties, including payment processors and delivery drivers d) Aggregate Liability: BADMC's total aggregate liability arising from your use of the Platform shall not exceed the total amount you have paid through the Platform in the 12 months preceding the claim, or BBD $100, whichever is greater.
16. Indemnification
You agree to indemnify and hold harmless BADMC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: • Your use of the Platform • Your violation of these Terms • Your infringement of any third-party rights • Any false or misleading information you submit BADMC reserves the right to assume the exclusive defence of any matter subject to indemnification, in which case you will cooperate with BADMC in asserting available defences.
17. Account Suspension and Termination
BADMC may suspend or terminate your account at any time, with or without cause, including: • Violation of these Terms or BADMC policies • Fraudulent or unlawful activity • Repeated failure to honour procurement commitments • Providing false farm data or misrepresenting eligibility • Security concerns or unauthorised access Upon termination: • Your access to all portals will be revoked • Pending payouts will be processed subject to review and any outstanding obligations • Transactional records will be retained as required by law You may request account deactivation at any time by contacting contactus@badmc.org.
18. Force Majeure
BADMC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by events beyond its reasonable control, including but not limited to: • Natural disasters, hurricanes, floods, or severe weather events • Pandemics or public health emergencies • Government actions, embargoes, or regulatory changes • Power outages, telecommunications failures, or internet disruptions • Labour disputes or civil unrest BADMC will use reasonable efforts to resume operations as soon as practicable following any such event.
19. Governing Law and Dispute Resolution
a) Governing Law: These Terms are governed by and construed in accordance with the laws of Barbados. b) Informal Resolution: Before initiating formal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation. A party must provide written notice of the dispute to the other party and allow 30 days for resolution. c) Jurisdiction: Any disputes that cannot be resolved through informal negotiation shall be subject to the exclusive jurisdiction of the courts of Barbados. d) Class Action Waiver: Any dispute will be resolved on an individual basis; class actions and representative proceedings are not permitted.
20. Changes to These Terms
BADMC may revise these Terms at any time. Material changes will be posted on this page with an updated revision date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. For significant changes that materially affect your rights, BADMC will make reasonable efforts to provide notice through the Platform or via email. It is your responsibility to review these Terms periodically.
21. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
